1. Scope


The following general terms and conditions apply to the consulting service provided by the nutritional consulting

2. Consulting service


The consulting service provided by Linh Le, a certified nutritionist and consultant for holistic health aims at improving the client’s diet, living conditions, relaxation, prevention, and holistic health. The information provided is purely informative and serves to impart knowledge and must under no circumstances be viewed as a substitute for professional advice or treatment by trained and qualified doctors or alternative practitioners. It does not contain any recommendations regarding specific diagnostic or therapeutic procedures. The content must not be understood as medical instructions or as a request for self-treatment or as a basis for self-diagnosis and self-medication, nor can they replace individual care by a doctor or alternative practitioner. The implementation of the recommendations discussed should always be discussed with a qualified therapist. Following the recommendations is at the client’s own risk and responsibility. Everything that the client does, receives, experiences, and will give within the consultation and guidance happens voluntarily, at his/her own risk, and on his/her own responsibility.


3. Data protection and confidentiality

The client expressly consents to electronic data processing within the framework of the following regulations. Client data is treated with absolute confidentiality. The data communicated by the client is used exclusively for the needs-based creation of personal offers and consultations as well as for the purposes of NIARIA’s own market research. The data will not be passed on to third parties. For the nutritionist, confidentiality applies to all matters discussed during the consultation. This also applies after the end of the contract. A release from the duty of confidentiality towards treating doctors or other persons must be approved in writing by the client.


4. Implementation of nutritional advice

The subject of the order is the provision of a service, e.g. nutritional advice, and not the achievement of certain physical success. The commissioned services are deemed to have been provided when the necessary analyzes and consultations have taken place. In the client’s own interest, the client undertakes to provide all information (personal details, nutritional records, and health status) truthfully and completely.


5. Conditions of Participation

If the client has health problems or existing illnesses, he must consult a doctor or alternative practitioner before the first session. A change in diet can have an impact on the client’s health, e.g. the dose of medication needs to be changed.


6. Limitation of Liability and Warranty

By submitting the registration data to the nutritionist Linh Le and agreeing to the terms and conditions listed here, regardless of whether in electronic or postal form, the client enters into a binding contract for the advisory service ordered. The due sum can be paid in one payment or in installments.


7. Cancellation of appointments

Cancellation of appointments (also applies to consultations via phone or internet): The client reserves a binding appointment with an agreed time. If the client cannot keep the date or want to postpone it, the client is asked to inform the nutritionist at least 24 hours in advance. This can be done by phone or email.


8. Limitation of Liability and Warranty

Liability of the nutritionist for direct or indirect consequential damage caused by the consultation is excluded. The consulting service is provided to the best of the nutritionist’s knowledge and belief, based on the latest state of science and technology, but no guarantee can be given for the success of the services. The consultation is help for self-help, the success of the consultation is therefore beyond the nutritionist's sphere of influence and depends largely on the cooperation of the client to be advised. Nutritional advice does not replace medical advice or medical therapy.


9. Protection of property

The information materials, reports, analyses, and other documents prepared in the context of nutritional consultation are exclusively personal and cannot be used by third parties. The client receives the exclusive and unrestricted non-transferable right of use to all documents and undertakes to use them exclusively for his own purposes and not to pass them on to third parties.


10. Severability clause

Should one of these regulations be ineffective, the effectiveness of the remaining regulations is not affected. The ineffective clause will be replaced by a regulation that the contracting parties would have agreed to according to the economic objectives and the purpose of these general terms and conditions if they had known the loopholes.


11. Waiver of the Right of Withdrawal

By purchasing this digital product, which includes access to educational content, you acknowledge and agree that you are expressly requesting immediate access to the product and its content. You understand and accept that due to the nature of the digital content (which can be accessed instantly), the 14-day right of withdrawal, as stipulated by consumer protection laws, is waived. Once the purchase is completed and the digital product has been made available to you, your right to withdraw from the contract is no longer applicable.


12. Final provision

Changes and additions to this contract must be made in writing to be effective. Verbal collateral agreements do not exist.
